North Carolina Foreclosure Timeline

1. Missed Payments

Homeowner misses 1-3 mortgage payments and incurs late fees.

2. Notice of Default

The lender notifies the borrower that they are in default on their mortgage.

3. Service of Process

The lender serves the summons and complaint with Foreclosure Notice of Hearing to the borrower. This is usually done by hand-delivery by the county sheriff or a licensed process server.

4. Foreclosure hearing

The Foreclosure Notice of Hearing sets the Hearing Date before the Clerk of Superior Court usually 30 - 60 day from the date of the notice. At the hearing the Clerk reviews and criteria the lender must fulfill in order to set an Auction date

5. Auction Scheduled

The sale is typically scheduled 30-45 days from the date of Hearing Date.

6. Home is Sold at Auction.

The highest bidder is determined at the auction. A 10 day clock starts during which time this bid can be upset. Upon the receipt of an upset bid another 10 clock start. This cycle continues until there are no more upset bids.
